1. About these Terms
These Terms and Conditions ("Terms") are a legal agreement between you and One Health Connect Pty Ltd (ABN 73 663 429 427) ("One Health Connect", "we", "us", "our"). They govern your use of the YourScan mobile app for iOS, the YourScan web portal and any related services (together, the "App").
By downloading, signing in to, accessing or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
What YourScan is
YourScan is a patient portal that lets you securely view imaging results, radiology reports, images and your imaging history from the radiology practice or hospital that performed your examination (your "Imaging Provider"). Depending on what your Imaging Provider offers, you may also receive notifications, exchange messages and documents with your Imaging Provider, and share your results and images with others.
We provide the technology. Your Imaging Provider provides your healthcare, controls your clinical records and decides what is released to you. Your Imaging Provider's own terms and policies also apply to the care it gives you.
Not medical advice
The App is an information access tool. It does not provide medical advice, diagnosis or treatment, and it is not a substitute for talking with a qualified health professional.
- Radiology reports are written for your referring doctor and may contain technical terms or findings that need clinical context. Please discuss your results with your referring doctor or treating practitioner before making any decision about your health.
- Do not delay seeking care, stop treatment or change medication because of something you see, or do not see, in the App.
- Any explanations, summaries or educational content in the App are general information only.
Emergencies
The App is not for emergencies. If you think you are having a medical emergency, call 000 (Triple Zero) immediately or go to your nearest emergency department. Messages sent through the App are not monitored around the clock and may not be read straight away.
2. Eligibility and your account
Who can use the App
You can use the App if you have been invited or enabled by an Imaging Provider that uses YourScan, and you are either:
- 18 years or older, accessing your own records; or
- under 18, where your Imaging Provider allows it and you are legally able to access your own health information; or
- a parent, guardian or other person legally authorised to access another person's health information (an "Authorised Representative").
If you use the App as an Authorised Representative, you confirm you have the legal authority to do so, you agree to these Terms on behalf of the patient as well as yourself, and you must stop using their records if that authority ends.
How your account is set up
Your YourScan account and login details are set up before you use the App, by your Imaging Provider or through the YourScan web portal. You cannot create an account in the App. The App is only used to sign in to your existing account with your mobile number, your password and an SMS one time code.
You agree to give true, accurate and complete information and to keep it up to date. We may refuse, delay or close an account if we cannot verify your identity.
Keeping your account secure
You are responsible for:
- keeping your password, verification codes and device secure and not sharing them with anyone;
- using a device lock (PIN, password or biometrics) on any device you use for the App;
- signing out when you use a shared or public device; and
- telling us straight away at support@scanaptics.zohodesk.com.au if you think someone else has accessed your account.
You are responsible for activity on your account that results from you not keeping your login details secure. You must not create an account for another person without their authority, or use someone else's account.
3. Using YourScan's features
Results, reports and images
- Your Imaging Provider decides which results are released through the App and when. Some results may only be released after your referring doctor has reviewed them, and some may not be released through the App at all.
- A result not appearing in the App does not mean it is normal, abnormal or missing. If you are waiting on a result, contact your Imaging Provider or referring doctor.
- Images shown in the App are for your personal reference. They may be compressed or optimised for a phone screen and are not intended for diagnostic use. Health professionals should access original diagnostic images through your Imaging Provider.
- The information shown comes from your Imaging Provider's systems. If you think something is wrong, such as incorrect personal details or a report that is not yours, stop using that record and contact your Imaging Provider promptly.
Messaging and documents
Where your Imaging Provider offers messaging, you can send it non urgent questions and documents. Messages are answered by your Imaging Provider, not by us, during its normal business hours. Do not use messaging for urgent or emergency matters. Anything you send may become part of your Imaging Provider's health record.
You must only upload documents that relate to your own care (or the care of the person you represent), that you have the right to share, and that do not contain malicious code.
Sharing your results
If you use a sharing feature to send a report or images to a doctor or another person, you are choosing to disclose your health information to that recipient. Please check the recipient carefully. We are not responsible for how the recipient uses or protects information once you have shared it, and you can stop further access to a shared link where the App allows it.
Notifications
We send SMS messages to your mobile number with sign in codes and to tell you when a new result is available, and the App may also show notifications if you allow them. Notifications are a convenience and may be delayed, blocked by your device or network, or not delivered. Do not rely on them alone for time sensitive health matters. They are kept general and do not show clinical details, but anyone who can see your phone may see that you have a new result.
4. Acceptable use
You must use the App lawfully and only for accessing and managing your own health information or the information of a person you are authorised to represent. You must not:
- access, or try to access, another person's records or account without authority;
- share your login details, or let anyone else use your account;
- copy, modify, reverse engineer, decompile or attempt to extract the source code of the App, except where the law expressly allows it;
- interfere with, disrupt, overload or bypass the security of the App or the systems connected to it;
- use bots, scrapers or other automated tools to access the App or collect data from it;
- upload viruses, malware or any harmful or unlawful content;
- send messages that are abusive, threatening, harassing, discriminatory or offensive to Imaging Provider staff;
- impersonate any person or give false information; or
- use the App for any commercial purpose, or in any way that breaches these Terms or the law.
5. Fees
The App is free for patients to download and use. We do not charge you for accessing your results through the App and there are no in-app purchases. Your mobile carrier may charge for data use. Fees for imaging services are set and charged by your Imaging Provider, not by us.
6. Intellectual property and licence
The App, including its software, design, text, graphics, logos and the YourScan, Clarity Suite and One Health Connect names, is owned by or licensed to One Health Connect and is protected by intellectual property laws.
Subject to these Terms, we grant you a personal, limited, non exclusive, non transferable, revocable licence to download, install and use the App on devices you own or control, for your personal, non commercial use only. All rights not expressly granted are reserved.
Your health information belongs to you and your Imaging Provider as the law provides. We do not claim ownership of it. You give us permission to host, store, transmit and display the information and documents you submit, only as needed to operate the App and as described in our Privacy Policy.
If you send us feedback or suggestions, we may use them to improve our products without any obligation to you.
7. Apple App Store terms
If you downloaded the App from the Apple App Store, the following applies in addition to the rest of these Terms:
- Acknowledgement. These Terms are between you and One Health Connect only, not Apple Inc. ("Apple"). One Health Connect, not Apple, is solely responsible for the App and its content.
- Scope of licence. Your licence to use the App is limited to use on Apple branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the App may be accessed by other accounts associated with you through Family Sharing or volume purchasing.
- Maintenance and support. One Health Connect is solely responsible for providing maintenance and support for the App. Apple has no obligation to provide any maintenance or support services.
- Warranty. One Health Connect is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation for the App.
- Product claims. One Health Connect, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession or use of it, including product liability claims, any claim that the App fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- Intellectual property. If a third party claims that the App or your possession and use of it infringes their intellectual property rights, One Health Connect, not Apple, is solely responsible for investigating, defending, settling and discharging that claim.
- Legal compliance. You represent that you are not located in a country subject to a United States Government embargo or designated as a "terrorist supporting" country, and that you are not on any United States Government list of prohibited or restricted parties.
- Developer contact. Questions, complaints or claims about the App should be sent to One Health Connect using the details in section 18.
- Third party terms. You must comply with any applicable third party terms of agreement when using the App, such as your mobile data provider's terms.
- Third party beneficiary. Apple and its subsidiaries are third party beneficiaries of these Terms. Once you accept these Terms, Apple has the right (and is taken to have accepted the right) to enforce them against you as a third party beneficiary.
8. Third party services and links
The App relies on services provided by others, including your device's operating system, the App Store, mobile networks and our SMS providers. The App may also contain links to third party websites, such as your Imaging Provider's website or health information resources. We do not control and are not responsible for third party services, websites or content, and your use of them is subject to their own terms and privacy policies.
9. Availability and changes to the App
We work to keep the App available and secure, but we do not promise it will always be available, uninterrupted or error free. Access may be affected by maintenance, updates, faults, internet or network outages, or problems with your Imaging Provider's systems. Where we can, we will give notice of planned maintenance.
We may update, change or remove features of the App from time to time, for example to improve security, meet legal requirements or respond to changes at your Imaging Provider. You may need to install the latest version of the App, or use a supported operating system version, to keep using it. If your Imaging Provider stops using YourScan, you may lose access to its records through the App, but you can still request them from your Imaging Provider.
10. Suspension, termination and account deletion
Ending your use
You can stop using the App at any time. To close your account, contact us at support@scanaptics.zohodesk.com.au. Once we verify your identity, we will close your account so it can no longer be used to sign in or view records. Your information is then kept as described in our Privacy Policy, and the clinical records your Imaging Provider must keep by law are not affected.
When we may suspend or close your account
We may suspend or close your account, or restrict access to particular features, if:
- you breach these Terms or use the App unlawfully;
- we reasonably suspect unauthorised access, fraud or a security risk to you, other patients or our systems;
- we cannot verify your identity or your authority as an Authorised Representative;
- your Imaging Provider asks us to, or stops using YourScan; or
- we stop offering the App, in which case we will give you reasonable notice where possible.
Where it is safe and reasonable, we will tell you before we act and explain why. Sections of these Terms that by their nature should continue after termination (including sections 6, 11, 12, 13 and 16) continue to apply.
11. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). Nothing in these Terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or changed.
Subject to that, and to the extent permitted by law, the App is provided "as is" and "as available", and we exclude all other warranties, conditions and guarantees that are not expressly set out in these Terms.
12. Limitation of liability
To the maximum extent permitted by law:
- Clinical content and decisions. Your Imaging Provider, and not One Health Connect, is responsible for the accuracy, content and timing of your results, reports and images, and for your clinical care. We are not liable for any loss arising from clinical content, from the release or non release of a result, or from any decision you or anyone else makes based on information in the App.
- Indirect loss. We are not liable for any indirect or consequential loss, or for loss of profits, revenue, data (other than as required by our Privacy Policy), opportunity or goodwill, however it arises.
- Things outside our control. We are not liable for loss caused by events beyond our reasonable control, including failures of the internet, mobile networks, app stores, device operating systems, third party services or your Imaging Provider's systems, or by your failure to keep your device and login details secure.
- Overall cap. Our total liability to you for all claims relating to the App or these Terms is limited to AUD 100.
These limits do not apply to liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, or for fraud.
13. Indemnity
To the extent permitted by law, you agree to indemnify One Health Connect against any loss, damage, cost or expense (including reasonable legal costs) reasonably incurred by us as a direct result of your wilful breach of these Terms, your fraudulent or unlawful use of the App, or your use of the App to access another person's information without authority. Your liability under this clause is reduced to the extent the loss was caused or contributed to by us.
14. Privacy
We handle your personal information, including health information, in line with the Privacy Act 1988 (Cth), applicable state health records laws and the YourScan Privacy Policy at onehealthconnect.com.au/yourscan/privacy. The Privacy Policy explains what we collect, how we use and protect it, how long we keep it and how you can access, correct or delete it.
15. Changes to these Terms
We may change these Terms from time to time, for example to reflect new features, legal requirements or changes at your Imaging Provider. We will post the updated Terms in the App and at onehealthconnect.com.au/yourscan/terms with a new effective date. If a change is material, we will tell you in the App or by email at least 14 days before it takes effect, unless the change is needed sooner for legal or security reasons. If you do not agree to the changes, you can stop using the App and ask us to close your account before they take effect. Continuing to use the App after that date means you accept the updated Terms.
16. Governing law and disputes
These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non exclusive jurisdiction of the courts of New South Wales and the Commonwealth courts sitting there. This does not remove any right you have to bring a claim in the state or territory where you live.
If you have a dispute with us, please contact us first so we can try to resolve it informally. We will respond within 30 days.
17. General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the App.
- Severability. If any part of these Terms is invalid or unenforceable, it will be read down or severed, and the rest continues in force.
- No waiver. If we do not enforce a right straight away, we have not given it up.
- Assignment. You may not transfer your rights under these Terms. We may transfer ours to a successor to our business, on the condition that your rights are not reduced.
- Notices. We may send you notices in the App, by push notification or to the email address on your account.
